The Health Care Decision

As I sit and digest the decision by the Supreme Court that came out a little over one hour ago, there are many things that are running through my mind.  The Supreme Court shot down the individual mandate as it pertains to the commerce clause of the Constitution and also as it pertains to the Necessary and Proper Clause of the Constitution.  The Chief Justice stated in his remarks on the decision that the individual mandate does stand as a tax by Congress. 


Chief Justice Roberts said “no suit for the purpose of restraining the assessment or collection of any tax shall be maintained in any court by any person."  Basically saying that those for which the tax is imposed, must first pay the tax and then sue for a refund on the tax.  The way that Obama sold the bill and Congress wrote the bill was for the "tax" to be a penalty.  Chief Justice Roberts stated that Congress already has the power to regulate commerce, but not to compel commerce.


Today is the day that the Chief Justice of the Supreme Court told the entire country and Former President Bush, who appointed him; that he is no longer a Conservative.  Chief Justice Roberts announced today that he is a CINO-Conservative in Name Only. 


Congress can and will by July 9th purpose a new bill that would completely do away with this tax.  Remember President George H. W. Bush stated in either 1988 or 1989 that he would not raise taxes, then he went back on that statement and raised taxes and in 1992 President Clinton was elected.  Obama sold this bill as a non-taxing bill, but his lawyers argued the case in Florida and Washington D.C. as the individual mandate is a tax not a penalty.


Obama just spoke with a smug smirk on his face, but just wait...Congress and the American people will get the last laugh.  Since the Court did not side in favor of the American citizens and the States, the Voting public will show you how we really feel come November.
